Attached is the Response to Ministerial Correspondence 26-070 in relation to the “fit and proper person” test and addressing the following questions:

1. What checks and balances are currently in place within the Firearms Safety Authority and Police to ensure there is no risk of unfair or selective targeting of licensed firearm owners on the basis of speech that has not met the criminal threshold for prosecution?

2. What is the practical line between speech that may justify administrative action against a firearms licence, and speech that must be dealt with through the criminal justice system? How was that line applied in the recent case involving Brian Tamaki?
